These Mobile Alerts Terms & Conditions (“Terms”) govern your enrollment in and use of the mobile text message (“SMS”) alerts and notifications provided by ProfileGorilla (“we,” “us,” or “our”). By opting in to receive SMS alerts, you agree to these Terms.

 

Mobile Alert Descriptions

By opting into Mobile Alerts, you may receive text messages related to:
 

• Account activity and security notifications

• Compliance or credentialing updates

• Appointment or task reminders

• Service updates, alerts, and time‑sensitive information

• Other messages directly related to your use of our platform
   

Message frequency may vary based on your activity and preferences.

Consent to Receive Messages
By providing your mobile number and opting in, you:
 

• Confirm that you are the authorized user of the mobile number provided

• Consent to receive recurring automated SMS messages, including via an automatic telephone dialing system (autodialer)

• Understand that consent is not a condition of purchase or service
   

Standard message and data rates may apply.

 

Opt‑Out Instructions
You may opt out of SMS alerts at any time by replying STOP to any message.   After opting out, you may receive a final confirmation message.  It is your sole responsibility to notify us if you no longer want to receive texts. Please allow up to ten (10) business days (unless otherwise required by applicable law) to process any opt-out request. Please note that even if you opt out of texts, we reserve the right to make non-automated texts to you.

Mobile Carrier Disclaimer
Delivery of SMS messages is subject to your mobile carrier’s network availability.  Carriers are not liable for delayed or undelivered messages.

Supported carriers may include AT&T, Verizon, T‑Mobile, and others.

 

Fees and Charges
Your mobile carrier’s message and data rates may apply.  You are responsible for any charges incurred from your carrier.

Privacy
Your privacy is important to us.  Information collected through the Mobile Alerts program is handled in accordance with our Privacy Policy.

We do not sell or share your mobile number with third parties for marketing purposes.

Eligibility
You must:
 

• Be at least 18 years old

• Provide a valid U.S. mobile phone number

• Have a mobile device capable of receiving SMS messages
   

Changes to the Program
We may modify or discontinue the Mobile Alerts program at any time.   We may also update these Terms, and continued participation constitutes acceptance of the updated Terms.​

Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
 

• Delays or failures in message delivery

• Errors in content

• Unauthorized access to your mobile device
   

Your use of the Mobile Alerts program is at your own risk.  You agree to indemnify us, our agents, affiliates, and independent contractors for any privacy, tort or other claims, including claims under the federal Telephone Consumer Protection Act (“TCPA”) or any state law equivalents, relating to your unauthorized provision of a telephone number and/or your failure to notify us of any changes in your contact information, including telephone number. You agree to indemnify, defend and hold us harmless from and against any and all such claims, losses, liability, costs and expenses (including reasonable attorneys’ fees). We shall have the exclusive right to choose counsel, at your expense, to defend any such claims. Your indemnity obligations under this Section will survive expiration or termination of this Agreement.
