MOBILE ALERTS TERMS

These Mobile Alerts Terms & Conditions (“Terms”) govern your enrollment in and use of the mobile text message (“SMS”) alerts and notifications provided by ProfileGorilla (“we,” “us,” or “our”). By opting in to receive SMS alerts, you agree to these Terms.
Program Description: ProfileGorilla update alerts provide automated status notifications to applicants regarding the phase, document requirements, and completion of their SubScreen reports.
Message Frequency: Message frequency varies depending on the status of your screening report and the number of verifications required, but will not exceed six per order.
Cost Disclosure: Message and data rates may apply. Check with your mobile carrier for your specific plan details.
How to Opt-Out: To stop receiving status updates via text, reply STOP to any message. You will receive one final text confirming your unsubscription.
How to Get Help: For assistance with your screening status or text alerts, contact our support team at support@profilegorilla.com.
Privacy & Security: We take data security seriously. Status alerts will never contain specific screening results or personal identification numbers. Review how we protect your data in our Privacy Policy. We do not sell or share your mobile number with third parties for marketing purposes.
Consent to Receive Messages
By providing your mobile number and opting in, you:

Confirm that you are the authorized user of the mobile number provided

Confirm that you at least 18 years old

Consent to receive recurring automated SMS messages, including via an automatic telephone dialing system (autodialer)

Understand that consent is not a condition of purchase or service
Mobile Carrier Disclaimer
Delivery of SMS messages is subject to your mobile carrier’s network availability. Carriers are not liable for delayed or undelivered messages.
Supported carriers may include AT&T, Verizon, T‑Mobile, and others.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for:

Delays or failures in message delivery

Errors in content

Unauthorized access to your mobile device
Your use of the Mobile Alerts program is at your own risk. You agree to indemnify us, our agents, affiliates, and independent contractors for any privacy, tort or other claims, including claims under the federal Telephone Consumer Protection Act (“TCPA”) or any state law equivalents, relating to your unauthorized provision of a telephone number and/or your failure to notify us of any changes in your contact information, including telephone number. You agree to indemnify, defend and hold us harmless from and against any and all such claims, losses, liability, costs and expenses (including reasonable attorneys’ fees). We shall have the exclusive right to choose counsel, at your expense, to defend any such claims. Your indemnity obligations under this Section will survive expiration or termination of this Agreement.
